1. Services Description

Golden Hat Connect provides a multi-tenant business communication and automation platform. Our Services enable businesses to connect, manage, automate, and orchestrate messaging channels, AI autopilot agents, shared inboxes, campaign broadcasts, and custom workflows.

Integrations currently include the WhatsApp Business Platform, with support for additional third-party communication channels and APIs introduced from time to time.

2. Account Registration & Security

To access Connect Studio, you must create an authorized business account. You agree to provide accurate, current, and complete registration information.

You are responsible for maintaining the confidentiality of your authentication credentials and for all activities conducted under your account. You agree to notify us immediately at support@goldenhat.io of any unauthorized access.

3. Connected Platforms & Acceptable Use

When connecting third-party channels (such as official WhatsApp Business Accounts), you represent and warrant that you hold all necessary ownership rights, business authorizations, and customer consents.

You agree not to use the Services to:

• Send unsolicited bulk communications (spam) or violate Meta / WhatsApp Business Messaging Policies.
• Process unlawful, harmful, deceptive, or abusive content.
• Bypass rate limits, security boundaries, or system access controls.
• Interfere with or disrupt the integrity or performance of the platform.

4. Data Ownership & Protection

You retain all ownership rights in your customer data, contacts, conversations, and business media processed through the platform.

Our processing of personal data is governed by our Privacy Policy.

5. Intellectual Property Rights

Golden Hat Technologies Pvt. Ltd. retains all right, title, and interest in and to Golden Hat Connect, including software, proprietary algorithms, user interface designs, logos, and documentation.

6. Subscriptions, Fees & Billing

Access to platform plans is billed on a prepaid subscription basis (monthly or annual). Usage-based charges, such as official WhatsApp / Meta conversation fees, are charged at actuals as billed by Meta or authorized solution providers.

All applicable statutory taxes, including Goods and Services Tax (GST), will be levied in addition to subscription and messaging fees as required by Indian tax laws.

7. Service Level & Availability

We strive to maintain 99.9% service availability. However, platform operational capacity depends in part on network providers and third-party APIs (such as Meta APIs). Maintenance windows or upstream outages may temporarily affect service availability.

8. Suspension & Termination

You may terminate your account at any time by contacting support or disconnecting your connected channels.

We reserve the right to suspend or terminate accounts that violate these Terms, breach third-party API policies, or pose a security risk to our systems or other users.

9. Limitation of Liability & Warranty Disclaimer

Golden Hat Connect is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

To the maximum extent permitted by law, Golden Hat Technologies Pvt. Ltd. shall not be liable for indirect, incidental, consequential, or punitive damages, or loss of profits or revenue arising out of or related to your use of the Services.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Alwar, Rajasthan, India.
